We Scots follow Scots law which relates back to Roman Law of years gone by, but your English law appears to be quite interesting, and I'm looking for clarification, not that it affects me, but crikey, a bit more research by some of yourselves could prove to provide startling information (one way or the other) I suspect.

Apparently....

All Councils in England are set up as COMPANIES/CORPORATIONS -

1. can anyone confirm that this is correct?

All COURTS in England are set up as COMPANIES/CORPORATIONS.

2. can anyone confirm whether this is also correct? (Im trying to help you England chappies)

This is done apparently in order to set a Jurisdiction of an "unlawful" STATUTE LEGISLATION

(Not I say unlawful and not illegal - 2 completely different terms)

Would I be right in thinking then that if an individual living in England receives a summons from a court in England then...

A summons could be interpreted as an invitation to attend their place of business to discuss the matter in hand, thus is construed as an "offer" (under contract law.)

Interestingly, all magistrates courts are deemed "Branches" of the Ministry of Justice which itself is a registered Business/Corporation, then I would hope you English chaps certainly do not agree to the jurisdiction of whic it is governed..

Am I also led to believe that as "CORPORATIONS" they then create a Legal Fiction by addressing you as a "Person" (in UPPER CASE) a seperate legal entity to you the named individual (under common law) to ensure that you comply with their requests and fall into their jurisdiction thus permitting them to deal with you in a matter as they deem fit.

If your COUNCILS are also registered Companies then all this council tax bills that they keep wanting to take you for court are then "unlawful" too?

If they are "selecting"/setting the jurisdiction to that of a Court de facto instead of a Court de Jeur are they not denying you the added protection of the case being held COMMON LAW and a jury of your peers?

Is that not your right?

In fact, what are your rights?

Do you actually know?

In fact what are the implications (past, present and future) if any?

(I certaintly don't - I'm Scottish)

Perhaps it's time to paint your faces Blue and start standing up for what you could be losing....

I thought ironic from the link above ( Court de facto ) of the chap emailing the court service, they couldn't reply as they didn't know what kind of court they were - it made me giggle.

Incidentally, in common law are corporations not legal fictions and thus then require contracts in order to claim authority or control over other parties.

So if they have no contract with you, and can't provide evidence of any such contract, hmmmmm.

Does that not also mean...

" legal fictions lack a soul and cannot exert any control over those who are thus blessed and operate with respect to that knowledge as only a fool would allow soulless fictions to dictate ones actions "

Why would you think that Scottish Government is not a registered Business/Corporation ?

For clarification, the set up is not as COMPANIES/CORPORATIONS but as Corporations.
"Corporation" as meaning a local governing body for some or all of the following:
Cities, counties, towns, townships, charter townships and villages, and is used in Canada, India, Sweden, Philippines and the United States besides the UK including Scotland. These "Corporations" are usually formed by a charter from the monarch or central/federal government.

I am not proclaiming to know what i am talking about in this scenario - i don't, but I'm prepared to ask and prepared to listen to someone who does know though.

However on the face of it (so far) it appears that if you're prepared to stand your ground with a "qualified acceptance" (in the right jurisdiction) and confirm that they are a CORPORATION contracting with you to provide a service and you ask for proof of the contract, then it opens up a whole can of worms.

I now wonder if the principle/process can be applied to a number of different instances like credit cards, bank loans etc

Did you sign a contract for your local "corporation" to empty your wheelie bins?

Or is it just extortion?

I have seen letters similar to this in the past. We've recently moved between councils and as yet have not been asked for any payment. For the sake of anonymity I'll call myself Steven, I wouldn't want the council tracking my real name wink

nocounciltax.com has the right idea and some people have withheld part payments due to new fortnightly collections etc. It is extortion, when one considers the amount of tax we already pay, to be legally bound to pay a large bill every month (larger than any bill I've ever paid bar business tax) for substandard services which change every couple of months and don't provide, just because I live within a certain jurisdiction... there is nothing fair about it.

They collect my bins once a month, I have no complaints about that. I have no use of their other 'services' and would at least want a discount! As above, nobody asked me... why should I be forced to pay?
